I'll make this short & to the point. I had a litter of pups roughly 3.5 mths ago and I sold a pup (which wifey wanted to keep but because it was staying local I talked her out of it) to what I thought was a friend. Visited the pup for pics and the next day the A-hole put the pup up for sale on Ebay classifieds. I didn't find out until 2 days later and ofcourse when I called he had already sold it. His reason is he needed money. I reminded him what I told him when he first bought the pup about a full refund no matter about health issues or just not the right pick. I'm so pissed and hurt. What can I do in the future contract wise to try to prevent this?

If you gave him full ownership
the dog was his property, and the AKC will see nothing wrong with him selling it. One way to prevent that in the future is to remain as a co-owner of the dog. That would prevent him from selling the pup with full registration. Of course, he could still sell the pup with no papers.

My contract states about returning the pup but it doesn't have any fines to it. I like your wording on what you suggested. Could I contact AKC about this and have the registration revoked? Needless to say I have taken it quite personal and cannot forgive him for doing it. The friendship is over between him and our family. That's what hits me like one in the gut, when it's done by someone you think is a good friend. Thanks for all your input.

Oh wow that was pretty low!
especially if you had told him you'd give him his money back. I like the idea of putting it into the contract that there will be pre-agreed upon by both parties penalties if the dog is ever re-homed or sold without contacting the breeder first.

you need to write in a "remedy" in case of failure to return the pup to you. For example, The puppy/adult will not be resold or rehomed under any circumstances. If the owner is unable to keep the puppy/adult for any reason, the puppy/adult will be returned to the breeder. If the puppy/adult is resold or rehomed without the written consent of the breeder, the owner shall remit to the breeder the amount of $5000.00 (or whatever amount you choose) in US funds.

hopfully its ok to post here on this? put in the contract the animal must come back to you if they dont keep it, also that there would be a court hearing if they dont follow the contract, they pay for all court costs and will be in the court system you choose. That should be enough to make them realize your serious.

I wonder if you could put a clause about not selling the dog period unless they contact you for approval.. It might slow down the sale process but it could prevent stuff like that. I'm not a breeder so i can't speculate on the exact specifics, but i have dealt with a lot of contracts for other instances. I would sure have cursed that jerk out, how do you buy a pup in the first place if your hard up for money? Geez....some people..
